Insurance & Limitations of Liability
This page describes the scope of the ChikitsaPro service, disclaimers, and limitations of liability. It should be read together with our Terms & Conditions and Privacy Policy.
1. Nature of the service
ChikitsaPro is a software-as-a-service (SaaS) platform that provides clinic management tools, including appointments, patient records, prescriptions, billing, and related features. It is not a substitute for professional medical judgment, diagnosis, or treatment. The software does not provide medical advice or guarantee clinical or regulatory compliance.
2. No professional indemnity or insurance
ChikitsaPro does not provide professional indemnity insurance, medical malpractice insurance, or any form of insurance coverage for your practice. You are solely responsible for maintaining appropriate professional indemnity and other insurance as required by your profession and by applicable law (e.g. medical council or institutional requirements). Use of this software does not replace or supplement such coverage.
3. Your responsibility
You are responsible for: (a) the accuracy and completeness of data you enter; (b) obtaining necessary patient consents and maintaining confidentiality as required by law; (c) compliance with medical council rules, prescription and record-keeping norms, drug regulations (e.g. CDSCO, Schedule H/H1), and data protection laws (e.g. Digital Personal Data Protection Act 2023); (d) the clinical and legal correctness of prescriptions and medical decisions. ChikitsaPro is a tool to support your practice; it does not assume any of these responsibilities.
4. Disclaimers
The Service is provided "as is" and "as available". We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components. We are not liable for any loss or damage arising from your use of or reliance on the Service, including but not limited to clinical, financial, or reputational loss. Medicine names, dosages, and suggestions in the product are for convenience only and do not constitute medical advice.
5. Limitation of liability
To the maximum extent permitted by applicable law, our total aggregate liability for any claims arising out of or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the first event giving rise to liability. We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of data, revenue, profits, or goodwill. These limitations apply whether the claim is in contract, tort, negligence, or otherwise. Some jurisdictions do not allow certain exclusions or limitations; in such cases, our liability is limited to the maximum extent permitted by law.
6. Service availability and data
We strive for high availability but do not guarantee uptime or that the Service will meet your specific requirements. You are encouraged to maintain your own backups of critical data where appropriate. We are not liable for loss of data due to your misuse, third-party actions, or circumstances beyond our reasonable control.
